Completing & paying your annual tax return

Every non-resident owner of a Spanish property has to submit an annual tax return to account for their “share” of the property.  Although it’s called an “income tax” it’s not actually based on your level of income but on a “deemed” or “notional” level of income which is a percentage of the rateable value of your property multiplied by the non-resident tax rate of 24%.

As it’s a self assessment system the Spanish Tax Office won’t chase you for payment, and many owners are not aware they need to submit a tax return or assume there’s nothing to pay because they don’t rent out the property.  This can cause real problems when you come to sell the property – you can find yourself liable for the outstanding tax, plus penalties and interest payments.
